Terms of Service

1. Acceptance of Terms

By accessing or using Lifestream Vault ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Lifestream Vault is a secure Markdown document storage service that provides:

  • Cloud-hosted document storage and organization
  • Real-time document synchronization via WebDAV
  • Full-text search and AI-powered features
  • REST API and SDK for programmatic access
  • Document sharing and publishing capabilities
  • Team collaboration features

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your email address remains current and valid

You must be at least 16 years of age to create an account.

4. User Responsibilities

You agree to:

  • Use the Service in compliance with all applicable laws and regulations
  • Not use the Service for any unlawful or prohibited purpose
  • Not attempt to gain unauthorized access to the Service or its systems
  • Not interfere with or disrupt the Service or its infrastructure
  • Not upload malicious content, viruses, or harmful code
  • Comply with the Acceptable Use Policy

5. Subscription Plans and Billing

5.1 Plans

The Service offers three subscription tiers: Free, Pro, and Business. Each tier includes different features and usage limits as described on our pricing page.

5.2 Billing and Refunds

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • We reserve the right to modify pricing with 30 days' notice
  • Failure to pay may result in suspension or termination of your account
  • Refund Policy: Refund requests are evaluated on a case-by-case basis. The amount of service usage consumed during the billing period (including API requests, AI tokens, storage, and other metered features) will be considered when determining refund eligibility and amount. For annual subscriptions, prorated refunds are available on a sliding scale that decreases as more of the subscription term has elapsed. Partial refunds may be less than a full prorated amount based on usage consumed. To request a refund, contact support@lifestreamdynamics.com within 30 days of the charge in question.

5.3 Free Tier

The Free tier is provided at no cost with limited features and storage. We reserve the right to modify Free tier limits at any time.

6. Intellectual Property

6.1 Your Content

You retain all rights to the content you upload, create, or store using the Service ("Your Content"). By using the Service, you grant us a limited license to store, process, and transmit Your Content solely as necessary to provide the Service.

6.2 Our Service

The Service, including its software, design, and documentation, is owned by Lifestream Dynamics and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. API Usage

Use of the Lifestream Vault API is subject to rate limits and usage quotas as defined by your subscription tier. You agree not to:

  • Exceed your allocated API rate limits
  • Use the API in a manner that degrades service for other users
  • Share API keys with unauthorized parties
  • Use the API for automated scraping or bulk operations without authorization

9. Document Storage

  • Documents are stored securely and encrypted at rest
  • We perform regular backups but do not guarantee against data loss
  • You are responsible for maintaining your own backups of critical content
  • Maximum document size and storage limits apply per your subscription tier

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible. Service Level Agreements for paid tiers are detailed in our SLA document.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFESTREAM DYNAMICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

Our total liability for any claims related to the Service shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Termination

13.1 By You

You may terminate your account at any time through the Service settings. Upon termination, your data will be retained for 30 days before permanent deletion, during which you may export your data or cancel the deletion.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, the Acceptable Use Policy, or for any other reason with 30 days' notice, except in cases of severe violations where immediate termination may be necessary.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Ontario, Canada.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
